As of this date, our unit is issuing a revised version of the standard special provision, Revision of Sections 105, 202, 401, 406 & 601 Hot Mix Asphalt Pavement Roadway Smoothness (High Speed Profiler). This revised standard special provision should be used immediately on projects having HMA pavement. Please note, however, that “revision under ad” will not be required for projects that are already advertised.

CAPA HOSTS GOVERNOR’S BLUE RIBBON TRANSPORTATION PANEL
CAPA joined other business and community leaders in Colorado Springs for a reception for the Governor’s Blue Ribbon Transportation Panel. The event was held Wednesday eveing, October 3, at the Sun Bird Restaurant and was co-sponsored by CAPA, CH2MHill, and the Colorado Springs Chamber of Commerce. CDOT Executive Director Russ George, Transportation Commissioner Terry Schooler, and a number of local elected officials joined Panel members at the event.
PANEL RECOMMENDS ADDING $300 M TO HIGHWAY SYSTEM QUALITY/SHOULDERS
The Governor’s Blue Ribbon Transportation Panel met in Colorado Springs for a day long meeting on Thursday, October 4, 2007 to evaluate and discuss transportation funding needs and priorities. Governor Ritter kicked off the meeting with opening remarks. The Panel came to a preliminary consensus to recommend an additional $222 Million/year for statewide highway system quality and $80 Million/year for Shoulder Upgrades on rural highways. Funding levels were also identified for other categories including completion of the 7th Pot, Safety, Mobility, Maintenance Level of Service, etc. The recommendations are still preliminary and subject to available funding. Panel member Carl Maxey of Maxey Equipment will be presenting an update on the work of the Panel at the CAPA All Member Meeting & Luncheon set for Friday, November 2, 2007 at Colorado State University in Ft. Collins. The next meeting of the panel is set for October 16 in Denver.
INCENTIVES FOR ROADWAY SMOOTHNESS TO INCREASE
The joint industry/CDOT Smoothness Task Force has recommended a doubling of the current incentive for smoothness on HMA paving projects. The current $0.32/sqyd would be increased to $0.64/sqyd. The CDOT MAC agreed to the recommendation and it is expected that the change will be made an incorporated into 2008 projects. The Task Force Meeting Minutes – September 5 are available for review. NEW AGREEMENT REACHED WITH CDOT ON LabCAT PROGRAM
A new five year agreement has been reached with CDOT on the continuation of the LabCAT Program. The Federally required certification program for asphalt technicians has been administered by CAPA since 1995. The joint CAPA/CDOT LabCAT Board of Directors (with representation from FHWA, ACEC, CAGE, and CARSE) will be meeting on October 3.
THERMAL SEGREGATION SPECIFICATION FINALIZED
The final version of the Thermal Segregation Specification has been approved by CDOT and will be used as standard special on all HMA/SMA projects next year.
CDOT NAMES REPLACEMENT FOR STAFF MATERIALS ENGINEER
CDOT Director of Staff Services Del Walker announced that Jim Zufall has been selected as the NEW Staff Materials Engineer. Jim replaces Tim Aschenbrener who became the Staff Project Development Engineer. Jim is currently a Resident Engineer in CDOT Region 4
CDOT LIFE CYCLE COST ANALYSIS OF HMA
Mode of Construction Adjustment
One potential change to CDOT’s life cycle cost analysis (LCCA) for hot mix asphalt is an adjustment for the difference in cost and production of a typical project (under traffic, lane-by-lane construction, work hour and work area restrictions) and a project considered for LCCA (detoured traffic, no work area restrictions, unlimited work hours). A Mode of Construction Survey has been developed and submitted to our producer members statewide. CAPA LEADERS MEET WITH CDOT EXECUTIVE DIRECTOR 
CDOT Executive Director Russ George met with members of CAPA’s Board of Directors on Friday, August 17th . A tour of the Rocky Mountain Asphalt Education Center 
was provided together with a luncheon. The focus of discussion at the meeting centered on the subject of transportation funding.
THERMAL SEGREGATION SPECIFICATION OUT FOR REVIEW
The CDOT Thermal Segregation Specification is being used on a pilot basis in 2007. There are 12 projects (two per region) using the specification. CDOT is planning to move to full implementation of the specification for 2008 projects. THE BALL STARTS TURNING ON FEDERAL TRANSPORTATION FUNDING
A CDOT coordinated SAFETEA-LU Reauthorization Steering Committee has been formed to support the timely and successful reauthorization of the Federal transportation funding legislation. CAPA’s Tom Peterson is a member of the Committee. The August 8 meeting of the committee included an informative presentation on understanding the Federal Surface Transportation Funding. BLUE RIBBON PANEL CONSIDERS HIGHWAY MAINTENANCE FUNDING THE TOP PRIORITY!!!!
The discussion of the Governor's Transportation Finance & Implementation Panel is progressing to the point where priorities of funding use is being considered. The Panel met in Akron on July 31 and discussed in small groups the options for additional transportation funding. Highway system maintenance has become the clear top priority of the Panel. CAPA has issued several perspectives on the issue including one entitled Safe and Smooth Colorado Roads Initiative.
REPORT FINALIZED ON THE USE OF SHORT TERM WARRANTIES
The Colorado DOT has issued a final report on the use of short term warranties. Current Cost-Benefit Evaluation of Short-Term Warranties For Hot Mix Asphalt Pavmeents (Report No. CDOT-2007-10), the report includes information on cost, quality, etc. impacts of using 3 and 5 year warranties. The report can be downloaded from the CDOT website. The report includes the following conclusions;
At this time, there was no tangible benefit identified. Based on the evaluation of these pavements, the implementation of short term warranties of HMA is currently not a cost-effective tool for CDOT.
TRANSPORTATION COMMISSION APPROVES FY08 DBE GOAL
A DBE Goal of 12.80% has been approved by the Transportation Commission for Federal Fiscal Year 2008. CDOT shall strive for 12.80% DBE participation in its state and federally funded contracting opportunities for construction and design projects. This is in comparison to the 2007 goal that was over 13%.
CHANGES CONSIDERED TO LIFE CYCLE COST ANALYSIS
CAPA has had a number of meetings recently with CDOT Pavement Design Program Manager Jay Goldbaum to discuss the CDOT life cycle cost analysis (LCCA) procedure. The discussion at the meetings has been the following three topics;
· Evaluating the performance life of asphalt pavements due to use of polymer modified asphalt
· Evaluating the maintenance costs of pavement types (asphalt versus concrete).
· Evaluating an adjustment to the asphalt analysis due to mode of construction differences (limited production window, under traffic, versus unlimited production window, detoured traffic.).
It is expected that the proposed changes will be submitted for approval to the CDOT MAC in September.
KEY PERSONNEL CHANGE - Tim Aschenbrener, CDOT Staff Materials Engineer, has accepted a position at CDOT Headquarters in Staff Services. A replacement for him as Staff Materials Engineer has not been announced.
A subgroup of the joint CAPA/CDOT RAP Task Force met on June 20 to provide direction on the issue of how to pay for the AC in the RAP on projects where AC is paid separately from the hot mix asphalt. TRANSPORTATION FUNDING UPDATE
The Governor's Blue Ribbon Transportation Panel (Colorado Transportation Finance & Implementation Panel) met on May 31st for a day long meeting and were provided with news that went from bad to worse. The need for additional funding for transportation in Colorado so greatly exceeds the current available funding that agencies - both state and local - are forced into "survival mode." CDOT AGREES TO RAP SPECIFICATION CHANGE One significant accomplishment of the joint CAPA/CDOT Recycled Asphalt Pavement (RAP) Task Force was to address how to handle mix problems on projects that use RAP. It was agreed to treat the RAP as virgin aggregate and eliminate the specification requirement that contractors have only one chance to run in the red with a RAP mix design before having to revert back to an all virgin mix. This change was approved by the CDOT Materials Advisory Committee (MAC) and will be implemented by CDOT. For additional information on the progress of the RAP Task Force click here.
WARM MIX ASPHALT TO BE PRESENTED AT SPRING AIF
The first warm mix asphalt project in Colorado will take place this construction season as part of an overlay project on I-70 near the Eisenhower Tunnel. To further our understanding of the warm mix asphalt technology, the spring Asphalt Industry Forum (AIF) meeting will include a presentation from Larry Michael – Consultant on “Lessons Learned and Best Practices in the Use of Warm Mix Asphalt.” Click here for the meeting announcement.
PLANS FOR MORE RUBBLIZATION PLUS ASPHALT OVERLAY ON I-25
If "all goes well" on the I-25 North rubblization project, CDOT Region 4 intends to program and bid another stretch of I-25 for rubblization plus asphalt work next year. They will "skip a section" and have tentatively planned for I-25, South of the Greyhound Dog Race track.
A Forum meeting has been scheduled between CDOT & CAPA to address HMA issues in Region 5. CDOT Region 5 staff will present the upcoming asphalt projects in the region. Also, maintenance officials will be present to explain the projected volumes of asphalt supply needed at various locations in the region during the 2007 construction season.

RAP TASK FORCE MAKING PROGRESS The joint CAPA/CDOT Recycled Asphalt Pavement (RAP) Task Force continues to meet and make progress. One of the key issues is How to Pay for RAP When AC Paid Separately. Here is the key question and proposed conclusion.
Question: On CDOT projects where asphalt cement is paid as a separate contractual bid item- how should RAP be paid?
Conclusion: In the cases where a contractor elects to use RAP in an approved mix design according to all relevant specifications and Section 401 asphalt cement is contractually paid separately, then the asphalt cement shall be paid according to the total average asphalt cement as tested by CP-L 5120.

CAPA/CDOT TASK FORCE TRACKING REPORT There continues to be a number of ongoing technical efforts with CDOT. This includes a joint Rice-Density Work Group. A CAPA/CDOT Task Force Tracking Report has been updated and is available for review.
Annually, CDOT contracts about 1.5 million tons of hot mix asphalt (HMA) to be placed throughout the state. HMA rehabilitation strategies, if properly designed and applied in a timely manner, would improve quality and reduce expenditures for the pavement network. Since 1997, CDOT has used Superpave to design its HMA pavements. Using the Superpave design, it is assumed that all these rehabilitation strategies perform for about ten years. This is a revision to section 105.03 Conformity to the Contract. All work performed and all materials furnished shall conform to the lines, grades, cross sections, dimensions, and material requirements, including tolerances, shown in the Contract.
All Hot Mix Asphalt and Stone Matrix Asphalt materials or work will be evaluated for conformity to the contract in accordance with Subsection 105.05 except Hot Mix Asphalt used for patching and temporary pavement. To view the entire 105.03 section in PDF, use this link.
PROJECTS SELECTED FOR USE OF AC PRICE ADJUSTMENT PROVISION

CDOT FINALIZES AC PRICE ADJUSTMENT CLAUSE - SEVEN PROJECTS SELECTED FOR USE IN 2007 The AC Price Adjustment Clause is complete and seven projects (thus far) have been identified for use in 2007. Two different specifications have been developed - one with AC Paid Separately and one with AC Paid as part of the HMA Bid Item. A list of projects are available to be reviewed. CDOT will track the use and cost of the specification in 2007 and evaluate future use following the construction season. CHANGES MADE TO ASPHALT SPECIFICATIONS
The CDOT Materials Advisory Committee (MAC) and Specification Committee have met recently to discuss and approve a number of changes to specifications. Here are several of the key changes to asphalt specifications.
- Item 202.09 for asphalt planning (rotomilling) was approved as a standard special provision.
- Modifications were approved to the smoothness specification. The HRI smoothness specification will be used on 100% of all asphalt paving projects in 2007.
- The use of a project special provision to address the possession of RAP millings was approved. The provision will be used on 1-2 projects on a pilot basis in 2007.

TRANSPORTATION CONFERENCE OCT 24-25
The 79th Annual Colorado Transportation Conference will be held Oct. 24-25, 2006, at the Holiday Inn Denver International Airport & Convention Center in Denver (I-70 at Chambers Road). The theme of the conference is "Connecting Colorado - Past, Present & Future". The keynote speaker will be Mary Peters, U.S. Secretary of Transportation Nominee. The featured national project is Colorado's own Eisenhower-Johnson Memorial Tunnels. Colorado Governor Bill Owens will deliver the address at the Annual Downing Award Luncheon on October 24th.
CDOT FINALIZES ASPHALT PRICE ADJUSTMENT CLAUSE
The CDOT Asphalt Price Adjustment Clause is near final. The specification has been developed to reduce the risk of future price fluctuations in asphalt binder and therefore to receive better bids. The specification is available for review.
